ShaCros Terms and Conditions of use
1. ShaCros. Maximilian A Shapiro and Alienor CC Cros are a partnership trading as ShaCros, MAS and Aesthetic Collection. The partnership will hereafter be referred to as ShaCros. References to “we”, “us” and “our” are deemed to be references to ShaCros. ShaCros.com and maximilianashapiro.com are wholly owned by ShaCros, including their subsidiary webpages, databases and all content therein. References to “The Websites” are considered to be references to ShaCros.Com and MaximilianAShapiro.com including subsidiary webpages, databases and content.
2. The User. Any persons accessing ShaCros.com or Maximilianashapiro.com are considered to be agreeing to the terms and conditions of use of the website as laid out in the following document and any supporting documents as enumerated at paragraph 12. Said persons will be known as “The User”. References to “you” or “your” will be considered references to The User.
3. Etsy. ShaCros use Etsy as a sales platform, operating from ShaCrosCards.etsy.com and MaximilianAShapiro.etsy.com as applicable. These two websites are owned and controlled by Etsy; references to ShaCros operations on these websites will be referred to as “The Etsy Store”.
4. Copyright. Under UK Copyright Law ShaCros asserts their ownership of the copyright of content included on The Websites. This includes product images, content elements such as banners and background images. This does not include components and contents created or furnished by Squarespace for the purposes of creating a website.
a. Fair Use. The User is permitted to disseminate or reproduce copyrighted content as long as credit is given to ShaCros for its creation and a direct link to ShaCros.Com or the webpage from which the content is taken is included within eyesight or embedded within the image.
b. Retention of Rights. ShaCros reserve the right to request that their copyrighted material be removed without justification.
c. Logos. All logos other than the ShaCros logo which appear on The Websites are used with permission either tacit or explicit of the logo owners and remain the property of their respective owners. ShaCros will accept any requests received in writing to remove logos used with assumed permission.
5. Limitation of Liability. To the fullest extent permitted by applicable law, ShaCros makes no warranties, either express or implied, about the Services. The Services are provided “as is” and “as available”. ShaCros also disclaims any warranties of merchantability, fitness for a particular purpose and non-infringement. No advice or information, whether oral or written, obtained by you from ShaCros, shall create any warranty. ShaCros makes no warranty or representation that the Services will be timely, uninterrupted or error-free; meet your requirements or expectations; or be free from viruses or other harmful components. In no event will ShaCros be liable for damages arising from use of The Websites.
a. Exceptions. Under certain circumstances, some jurisdictions don't permit the disclaimers in para 4, so they may not apply to you. However, the disclaimers apply to the maximum extent permitted by applicable law. You may have other statutory rights and nothing in this Agreement affects your statutory rights or rights under mandatory laws. The duration of statutorily required warranties, if any, shall be limited to the maximum extent permitted by applicable law.
6. Product Information. Weights, dimensions and descriptions of goods given by us to you for any purpose are stated in good faith but are approximate only and will not bind ShaCros in any way. We reserve the right to withdraw, or amend, the specification of any goods without further notice to you. Please allow variance on sizes stated especially when orders are placed at different times. We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on The Websites are correct at the time when the relevant information was entered onto the system. We reserve the right to refuse orders where product information has been mis-published, including prices and promotions. All information and advice either published on The Websites, sent to you by email or shared with you over the phone has been supplied in good faith and can only be interpreted as general guidance.
a. Visual Depictions. Photographs of the products are provided for illustrative purposes only. We are unable to guarantee colours will match what is displayed by your device’s screen.
b. Prices. All prices include VAT and exclude postage, packaging and duties as applicable. Postage and packaging will be calculated at check-out. All products are posted from the United Kingdom and foreign customers may be liable for import duties and dues. Prices are correct at time of publishing. In the event of any discrepancy between prices, the price listed at The Etsy Store will hold primacy.
c. Discount Codes. Discount codes will from time to time be issued for use at The Etsy Store. Only once code may be used on each purchase at a time. ShaCros retain the right to cancel or otherwise deactivate a discount code at any time.
7. Right of Refusal. ShaCros retain their right to refuse sale to any persons without justification within applicable law.
8. Dispatch and Shipping. ShaCros can guarantee that all products will be ready for dispatch no later than 2 working days following the submission of an order unless a shipping hiatus is posted to the website. All shipping is conducted through Royal Mail. ShaCros cannot guarantee dispatch dates and times or shipping speed. Express delivery, which will incur an extra charge, can be requested via The Etsy Shop.
9. Returns. ShaCros will not accept returns of goods. If goods are delivered faulty to the customer, a full refund or like-for-like replacement will be supplied on receipt of evidence of their faulty state on arrival.

11. Amendments. We reserve the right to amend these terms and conditions at any time. It is the responsibility of The User to be familiar with the latest copy of the terms and conditions. ShaCros will make sure that this policy is easily accessible from any page on The Websites.
ShaCros Data Handling and Processing Policy
1. Statement of Principle. ShaCros is committed to handling your data sensitively and legally. We collect only the minimal data required to conduct our business in accordance with the customer’s wishes and are happy to comply with all applicable UK and EU law. We do not sell data as a matter of principle.
2. Security and Transfer. All digital data is routinely stored on commercial servers with security assured by the Microsoft Corporation. Data is therefore not strictly held within the EU and may be transferred to any geographic location Microsoft cloud services operates in. Physical data is stored in the United Kingdom in a building which is not open to the public.
3. Exercising your rights in relation to your data. If you desire to exercise your GDPR rights in accordance with UK or EU Law, you may reach the ShaCros data controller by emailing info [at] shacros.com. Please include “FAO Data Control” in the subject line to expedite your request.
Customer Data
4. Nature of Data collected. ShaCros collects the following categories of Personal Data from customers for the reasons listed below. Customer Data is never sold or divulged to third party businesses. Customer Data will only be divulged to governmental organisations in accordance with legal due process.
First Name and Surname: Mailing of products; addressing of correspondence
Address: Mailing of products
Email address: Correspondence; confirmation of dispatch; marketing and newsletters (if opted in)
Purchase History: Marketing and newsletters (if opted in)
5. Customer Data retention period. Customer Data will be retained until such a time as the customer requests that the data be deleted, or ShaCros chooses to delete it, whichever is the earlier.
